Privacy Statement

Our customers are entitled to expect that LawAccess NSW will treat any information provided it by a customer within the terms of relevant privacy responsibilities. These responsibilities include Privacy Act 1988, Privacy and Personal Information Protection Act 1998 (NSW) and the NSW Attorney General's Department Privacy Management Plan. This privacy statement applies to all pages on LawAccess NSW, unless otherwise indicated.

Does LawAccess NSW use cookies?
No. LawAccess NSW does not use cookies.


What information do we collect?
When you look at LawAccess NSW, the Attorney General's Department computers record information which identifies, for each page accessed on LawAccess NSW, the IP (Internet Protocol) address of the machine which has accessed it.
For example, our usage reports will examine trends based on the following information - your server address, your top level domain name (for example .com, .gov, .au, .uk etc), the date and time of visit to the site, the pages accessed and documents downloaded, the previous site visited, the type of browser used and operating system.

What will we do with the information?
To improve the services provided by LawAccess NSW, we will extract and publish aggregated information about usage patterns from these records.


What won't we do with the information?
The LawAccess NSW will not disclose or publish information which identifies individuals, individual machines, or potentially identifies sub-groupings of addresses, without consent.

Who has access to information within the Attorney General's Department?
The Attorney General's Department is an Internet Service Provider and captures this information on its own computers. Access to the raw data is restricted to a limited number of officers in the Department for the purpose of analysis and to report on the success of LawAccess NSW in meeting the Department's communication and access objectives. The officers who can access this data are:

The Director General,
The Director, Information Technology Branch,
The Director LawAccess NSW, and

Project Officer LawAccess Online.

Is the raw data stored in a secure way?
Yes. The raw data is stored in a secure format and held by the Attorney General's Department for archival purposes.

What exceptions are there to this rule?
The NSW Attorney General's Department will gather more extensive information than stated above in the following circumstances:
  • unauthorised attempts to access files which are not published LawAccess NSW pages;
  • unauthorised tampering or interference with files published on LawAccess NSW;
  • unauthorised attempts to index the contents of LawAccess NSW by other web sites;
  • attempts to intercept messages of other LawAccess NSW customers;
  • communications which are defamatory, abusive, vilify individuals or groups or which give rise to a suspicion that an offence is being committed in relation to our web services;
  • attempts to otherwise compromise the security of the web server, breach the laws of the State of New South Wales or Commonwealth of Australia, or interfere with the enjoyment of LawAccess NSW by other customers.

The Attorney General's Department reserves the right to make disclosures to relevant authorities where the use of LawAccess NSW raises a suspicion that an offence is being, or has been, committed in relation to our web services.

In the unlikely event of an investigation, the Attorney General's Department will provide access to data to any law enforcement agency that may exercise a warrant to inspect our logs.

Use of information collected
We will only record your e-mail address if you send us a message. Your e-mail address will only be used for the purpose for which you have provided it and it will not be added to a mailing list or used for any other purpose without your consent.


Customers should be aware that there are inherent risks transmitting information across the Internet. If the feedback form or online advice form are used LawAccess NSW will make reasonable attempts to secure data. If information is submitted by email we do not warrant or guarantee that the information is secure.

What will we do with information provided in Feedback Forms?
Feedback forms on LawAccess NSW allow customers to provide valuable input into the future development of the site and to comment on the provision of services by LawAccess NSW.

The provision of personal details on feedback forms is optional.

Customers may provide personal details for the purpose of receiving a reply to their feedback. This information will only be used for the purpose for which it was provided. We will not add your email address or name to any mailing list.

LawAccess NSW may publish aggregated information about feedback on the site, to the extent that it does not identify or cannot be used to identify individual customers.

Submitting requests for Online Legal Advice
Customers must provide personal details for the purpose of receiving legal advice so we are able to contact you. This information will only be used for the purpose for which it was provided.

What can I do if I believe you have breached my privacy
If you believe you rights to privacy has not been respected you can make a complaint to the NSW Privacy Commissioner.

Will this policy be updated over time?
Due to the developing nature of privacy principles for online communication, this policy may be modified or expanded in light of new developments or issues that may arise from time to time.
